The license holder must verify and maintain evidence of staff competency, including documentation of: (1) education and experience qualifications relevant to the job responsibilities assigned to the staff and to the primary disability of persons served by the program, including a valid degree and transcript, or a current license, registration, or certification, when a degree or licensure, registration, or certification is required by this chapter or in the support plan or support plan addendum; (2) demonstrated competency in the orientation and training areas required under this chapter, and when applicable, completion of continuing education required to maintain professional licensure, registration, or certification requirements. (c) The license holder must ensure the following information is documented in the person's medication administration record: (1) the information on the current prescription label or the prescriber's current written or electronically recorded order or prescription that includes the person's name, description of the medication or treatment to be provided, and the frequency and other information needed to safely and correctly administer the medication or treatment to ensure effectiveness; (2) information on any risks or other side effects that are reasonable to expect, and any contraindications to its use. The license holder must collect and report on medication and symptom-related data as instructed by the prescriber. Services identified in section 245D.03, subdivision 1, paragraph (c), clauses (1) and (2), item (ii), must comply with the requirements in section 245D.07, subdivision 2. (b) Mechanical restraint does not include the following: (1) devices worn by the person that trigger electronic alarms to warn staff that a person is leaving a room or area, which do not, in and of themselves, restrict freedom of movement; or. (e) During the temporary suspension period, the license holder must: (1) provide information requested by the person or case manager; (2) work with the support team or expanded support team to develop reasonable alternatives to protect the person and others and to support continuity of care; and. Community residential settings and day service facilities. (b) The license holder must permit each person to remain in the program or to continue receiving services and must not terminate services unless: (1) the termination is necessary for the person's welfare and the license holder cannot meet the person's needs; (2) the safety of the person, others in the program, or staff is endangered and positive support strategies were attempted and have not achieved and effectively maintained safety for the person or others; (3) the health of the person, others in the program, or staff would otherwise be endangered; (4) the license holder has not been paid for services; (5) the program or license holder ceases to operate; (6) the person has been terminated by the lead agency from waiver eligibility; or. The personnel record must include: (1) the employee's date of hire, completed application, an acknowledgment signed by the employee that job duties were reviewed with the employee and the employee understands those duties, and documentation that the employee meets the position requirements as determined by the license holder; (2) documentation of staff qualifications, orientation, training, and performance evaluations as required under section 245D.09, subdivisions 3 to 5, including the date the training was completed, the number of hours per subject area, and the name of the trainer or instructor; and.
